Introduction The purpose of this page is to advise and legally permit, bind, and restrict the usage of modules created by David Cox. I wish to give official permission in some way as well as clearly restrict the usage of my modules (which I create). General Module Copyright Use and Restrictions I, David Cox, grant anyone the right to view and copy my e-Sword modules without remuneration to or permission from me. This right which I grant can be revoked at any time, so you need to check at this website or with me from time to time to see if there are changes to this grant. I restrict the use of my e-Sword modules to private and personal use, for which no gain is made directly from the hosting, viewing, copying, selling, etc. of my modules. In other words, you can download them, them can use them personally, you can copy them in any format and give them away, but: (1) you cannot sell my e-Sword modules, including charging for postage, packaging costs, reproduction costs, or hosting costs. This includes combining my modules with other modules and charging for the other modules. This includes posting them on a website and charging for access to them in any way. If they are reposted on the Internet, they must not be behind a password secured place, whether that password is charged for or only requested. (2) you cannot modify my e-Sword modules. If you find errors, please report them to me and I will make amends. This also specifically refers to removal of my copyright on my modules. As far as I know, my modules are not copyright infringements of other people's copyrighted material. I usually either write my modules personally, or I ascertain the publication date of the original work, or the death of the original author. In some cases, the author is unknown, making it impossible to know this matter. In any case, if you think you have a copyright dispute with me for my material, please write me with the situation. Please note that I appreciate it if you want to correct the world and be the copyright police of the DMCA, but copyright issues are between the copyright holders (usually the original content author, or the commercial publishing house or lawyer that is handling his material) and me. Advise me all you want and I will look into it, but I really do not see a great obligation on my part when third parties stick their nose in things where they don't belong! Somewhere in the legalities of copyright law, Hollywood movie studios, Music Recording Companies, the local, the ministry, and God, we have lost sight of what we are doing here. Religious material is under all copyright laws, but the natural of the material is also public and open. I preach a sermon to whomever comes to hear me, and this means it becomes "public" in some sense. On the one hand I do not think it is correct for others to make financial gain from my work without my permission and my cut of the profits, and on the other hand, all my work should be for the glory of God and not for a personal gold lust (which disqualifies me from the ministry in the first place). Having said that, I also understand that copyright law looks at intent as much as actions, and my "intent" in posting other people's works is to promote their work at my cost. I pay for the web hosting of their material. I pay with my time and energy to maintain this hosting website. I pay for searching for their material in the first place. That being the case, and the fact that I get no payment whatsoever for doing all this, I do not make a profit. I offer to some who like my site the option of donating to my ministry through my paypal. This is because I am a missionary, and many Christian people and supporting churches pay my salary. I get nothing guaranteed. I live by free will offerings, and there is a lot of effort in that aspect by me with little economic reward. People see my ministry as (1) missionary, (2) pastor, (3) Christian author of new and good material, (4) website religious library (non-eSword), and (5) e-Sword libraries, and they donate. In the order of importance, e-Sword is last on the list in my mind. I have had a donate "through Paypal link" on my Religious Library site for 5 years and have yet to have one single donation through that link (or any other way that they told me it was for my website efforts). I doubt if I get 1-2 emails PER YEAR from thankful people who cross my website (in English). In Spanish which is my main ministry, I get about 2-5 emails PER MONTH from grateful people thanking me. The reason why they thank me is because they have no money, and what they see, perceive, download, and use is understood by them as of being of great value to them in the ministry. My Spanish e-Sword modules are a fraction of what I have in English if you remove my personal writings and sermons. All of that leads me to an observation. I give freely and get hardly anything this side of heaven for all the work I do. I am satisfied with this situation. I perceive that a good many of the original content authors and the module creators (using out of copyright content) of the modules I post have the same spirit. If you see one of your modules here, and you are not in that freely-you-have-received, freely-you-give-spirit, please tell me so and I will gladly remove and band all your material from my website, and all links and references to it also. I wrote some years back a Rev. David Cloud of way-of-life.com website asking permission to send some of his posts through emails. He refused telling me I had to link. He puts excessive headers that are obligatory on all of his material. About 90% of his material he gets off the Internet without permission. His material will not be used by me. You wish to be added to my bad list, write me and I will gladly put you on it. |
